GCE wins award of maximum fees and expenses for hospital client

C.J. Gideon and Kaycee Weeter were granted a first appellate decision affirming award of maximum fees and expenses to our hospital client for dismissal of several claims in a multi-count complaint by a physician asserting improper termination of his medical staff privileges.

GEC wins on summary judgment for cancer treatment provider

09/26/2016 -

Chris Tardio and Blake Carter obtained summary judgment in a claim against a provider of specialized cancer treatment, on behalf of the company that provides the cancer treatment. The complaint was pending in Hamilton County Circuit Court and was dismissed with prejudice.

Summary Judgment Granted on Claim in Mass Tort Case

08/05/2016 -

C.J. Gideon, Chris Tardio, and Matt Cline briefed and won summary judgment on a strict liability claim against our clinic clients in a pending multi-year, multi-district litigation, stemming from the 2012 fungal meningitis outbreak. This particular issue has been litigated for several years across two states and four different courts, and now decided in our clients' favor.

GCE Wins Trial for Nashville Surgeon

10/14/2014 -

After a six day jury trial in Nashville, GCE attorneys Bryan Essary and Alan Bean obtained a unanimous verdict in favor of their client, a Nashville based surgeon.  The Plaintiff alleged delayed diagnosis of breast cancer, and sought damages for mental anguish and an alleged "lost opportunity to survive."  The jury unanimously found for GCE's client, and determined that the surgeon met the applicable standard of care.

GCE wins on summary judgment for local hospital

On October 24, 2014, the Circuit Court for Davidson County granted our client, a local hospital, summary judgment and dismissed the case against the hospital.  The Plaintiff claimed the hospital was responsible for her slip and fall at the hospital.  The judge dismissed the Plaintiff's complaint on all claims.  Bryan Essary and Blake Carter represented the hospital.

GCE Successfully Represents Physician in Board of Medical Examiners' Hearing

On September 18, 2014, after a hearing, the Tennessee Board of Medical Examiners granted an unrestricted Tennessee medical license to a physician without US-specific medical training.  Blake Carter represented the physician through each step of the administrative process, including filing the petition for declaratory order and representation at the Board hearing.

On July 25, 2014, the Circuit Court for Robertson County granted our client, a licensed physician, summary judgment and dismissed the case. The Plaintiff alleged inappropriate conduct by the physician during a routine medical examination.  The judge dismissed the Plaintiff's complaint on all claims. Tennessee Court of Appeals affirms jury verdict in favor of GCE client

06/30/2014 -

After briefing and oral argument, the Court of Appeals, in an opinion issued June 30, 2014, affirmed the jury's verdict in favor of the defendant physicians, a case that was tried in 2013 after over ten years of litigation. Tennessee Court of Appeals affirms jury verdict in favor of GCE client.

On December 30, 2013 the Tennessee Court of Appeals affirmed the jury verdict for Neurological Surgeons, P.C. in a post-operative paralysis case.  The Supreme Court denied the application for permission to appeal on May 14, 2014. GCE wins jury verdict for Cleveland, TN Hospital

01/15/2014 -

After a 3 day jury trial in Cleveland, Tennessee, C.J. Gideon and Chris Vrettos obtained a unanimous verdict in favor of their hospital client.  The Plaintiffs alleged that an employed nurse failed to provide adequate assistance while transferring the patient to a wheelchair, leading to a fall and bilateral wrist fractures.  After deliberating for less than an hour, the jury found the hospital's nurse complied with the applicable standard of care.
